Terms of Use

The terms on which you may use Diamond Data PRO, Hit & Hustle Tracker, and this website.

1. Agreement

These Terms of Use are an agreement between you and Blacktip Baseball, LLC (“we”, “us”) covering the Diamond Data PRO and Hit & Hustle Tracker mobile applications and this website (together, the “Services”). By creating an account or using the Services, you accept these Terms. If you do not accept them, do not use the Services.

2. Accounts and eligibility

The Services are intended for adults. You must be at least 18, or the age of majority where you live, to create an account. You are responsible for keeping your credentials secure and for activity that happens under your account.

One account may be used across both apps. You may invite others to your teams with owner, coach, or viewer permissions; you remain responsible for who you invite and what they can see.

3. Subscriptions, billing, and founder pricing

Paid features require an active subscription. Subscriptions are sold and billed through the Apple App Store or Google Play, not by us directly. Their terms govern the transaction, and your relationship for payment purposes is with them.

• Subscriptions renew automatically at the end of each period unless you cancel beforehand.
• You cancel through the store — App Store or Google Play subscription settings on your device. We cannot cancel a store subscription for you.
• Canceling stops the next renewal. It does not refund the period you are already in.
• Refunds are handled by Apple or Google under their policies. We will help where we can but we cannot issue a store refund ourselves.
• Free trials, where offered, vary by store and plan and are shown before you are charged.

Founder pricing. Where you subscribe at a rate identified as a founder rate, that rate will not be increased for as long as your subscription remains continuously active, including if we raise list prices. If your subscription lapses or is canceled, the founder rate ends with it, and any later subscription is at the then‑current rate. Founder pricing applies to the price only; it is not a guarantee of any particular feature set continuing to exist.

We may change list prices for new subscriptions at any time. Where a change would affect an existing subscription, it will be made only as permitted by the applicable store and with the notice they require.

4. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code or underlying models of the Services, except where that restriction is prohibited by law.
• Resell, sublicense, or provide the Services to third parties as your own product.
• Use automated means to scrape, overload, or interfere with the Services or their infrastructure.
• Upload unlawful content, or content you have no right to upload.
• Attempt to access another account, team, or organization’s data.

5. Your data and your responsibility for it

You retain ownership of the roster, player, and game data you enter. You grant us the limited licence needed to host, process, and display it in order to operate the Services for you.

You are responsible for having the authority to enter the information you enter, including information about minors, and for complying with your league’s rules and any applicable consent requirements. See the Privacy Policy for how that data is handled. We recommend entering no more identifying detail than the apps actually need.

6. Intellectual property

The Services, including the software, optimization logic, interface designs, text, and the Diamond Data PRO and Hit & Hustle Tracker names and marks, are owned by us or our licensors and are protected by intellectual property law. These Terms grant you a limited, revocable, non‑exclusive, non‑transferable right to use the Services while your account is in good standing, and nothing more.

7. No guarantee of athletic results

This clause matters, so it is in plain language rather than buried.

Diamond Data PRO produces a batting order that maximizes projected run production based on the statistics you supply. A projection is an expected value across many games. It is not a prediction of any single game, and we do not guarantee that using the Services will cause your team to score more runs, win more games, or improve in any measurable way.

Outcomes in baseball and softball depend on opposing pitching, defense, weather, umpiring, player development, and a very large amount of chance. The Services are a decision‑support tool for the coach, who remains responsible for every coaching decision made. Statistical output should not be treated as instruction, and should never override your judgment on player safety, playing time obligations, or league rules.

8. Availability and changes

We aim to keep the Services running but do not promise uninterrupted availability. We may modify, suspend, add, or remove features; where a change materially reduces the core functionality of a paid plan, we will give reasonable notice.

9. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Services will be error‑free, that defects will be corrected, or that any statistical output is accurate or suitable for your purpose.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost data, or lost opportunity, arising out of or relating to your use of the Services.

Our total aggregate liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us for the Services in the twelve months before the claim arose, or (b) twenty‑five United States dollars.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here excludes liability that cannot lawfully be excluded.

11. Termination

You may stop using the Services at any time. Data deletion is performed inside each app, under Account, and each app deletes only its own data. Deleting the shared sign‑in that both apps use is a separate step, handled on request — see diamonddatapro.com/account-deletion, which also covers what to do if you can no longer reach the app. Deleting your data does not cancel a subscription purchased through Apple or Google — cancel that through the store that holds the billing relationship. We may suspend or terminate an account that breaches these Terms, or where required by law. On termination, the rights granted to you end; sections 5, 6, 9, 10, and 12 survive.

12. Governing law and disputes

These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict‑of‑law principles.

Exclusive venue for any dispute arising out of or relating to these Terms or the Services is Pinellas County, Florida — specifically the state courts located in Pinellas County, Florida, or the United States District Court for the Middle District of Florida, Tampa Division. You and we consent to personal jurisdiction and venue in those courts and waive any objection to them, including any objection based on inconvenient forum. The sole exception is that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.

Before filing anything, please email support@diamonddatapro.com. Nearly everything is resolvable that way and we would rather resolve it that way.

13. Apple and Google

Where you obtain an app through the Apple App Store or Google Play, you acknowledge that these Terms are between you and us and not with Apple or Google; that they have no obligation to provide support for the apps; and that they are not responsible for any claim relating to the apps. They are, however, entitled to enforce the terms of this section as third‑party beneficiaries.

14. Changes to these Terms

We may update these Terms. The date at the top will change, and for material changes we will notify you in the app or by email. Continuing to use the Services after a change takes effect means you accept the updated Terms.
